Booking Terms and Conditions

These Booking Terms and Conditions contain important information. It is essential that you read them carefully and understand them. The Booking Terms and Conditions constitutes a legally binding contract between Himalayan Challenge Treks Pvt Ltd and you for the services provided by Himalayan Challenge Treks and set out the basis of your legal relationship with Himalayan Challenge Treks.

These Terms and Conditions (“Agreement”) are entered into between you (“Participant” or “You”) and Himalayan Challenge Treks Pvt Ltd (“Company” or “We” or “Our”) and govern your participation in any trekking, adventure, or travel program organized or facilitated by the Company. By participating in any such program, you acknowledge and agree to be bound by these Terms and Conditions.

Booking and Payment:

1.1. Reservation: To secure your place on a trekking program, you must complete the reservation process and provide all required information accurately.

1.2. Deposit: A non-refundable deposit, as specified during the reservation process, is required at the time of booking. The deposit amount will be deducted from the total program cost.

1.3. Final Payment: The remaining balance of the program cost must be paid before the specified due date, as communicated by the Company. Failure to make the final payment may result in the cancellation of your reservation.

1.4. Payment Methods: We accept payment by various methods, including bank transfers, online payment platforms, and credit/debit cards. Additional transaction fees may apply.

Please note that participants are responsible for any additional fees or charges imposed by their own banks or financial institutions for receiving international transfers. Himalayan Challenge Treks Pvt Ltd will not be liable for any such charges.

Cancellation and Refunds:

2.1. Cancellation by Participant: If you wish to cancel your reservation, you must notify the Company in writing. The cancellation will be effective from the date of receipt of your written notification.

2.2. Refund Policy: The refund amount will be determined as follows:

  • Please note that, if you cancel your trip after booking, you will lose your booking amount (30% of the trip).
  • If you leave a trip voluntarily for any reason, once the trip commences, you will not get any refunds.

2.3. Cancellation by Company: The Company reserves the right to cancel or modify a program due to unforeseen circumstances or events beyond its control. In such cases, alternative options or a full refund will be offered to the Participant.

Participant Responsibilities:

3.1. Health and Fitness: Participants must ensure they are in good health and possess the physical fitness necessary to undertake the chosen program. It is recommended to consult with a healthcare professional before participating in any trekking or adventure activity.

3.2. Travel Documents: Participants are responsible for obtaining and possessing all required travel documents, including passports, visas, permits, and any other documentation necessary for the program.

3.3. Code of Conduct: Participants must adhere to the local customs, laws, and regulations of the countries visited during the program. Disruptive or illegal behavior may result in removal from the program without any refund.

Travel Insurance:

4.1. Insurance Requirement: Participant’s comprehensive travel insurance that covers personal accidents, medical expenses, emergency evacuation, trip cancellation, and loss of personal belongings is necessary. Proof of insurance must be provided to the Company before the program commences.

4.2. Insurance Responsibility: Participants are responsible for reviewing and understanding the terms and coverage of their travel insurance policy. The Company shall not be liable for any expenses or losses incurred due to inadequate or insufficient insurance coverage.

Limitation of Liability:

5.1. Assumption of Risk: Trekking and adventure programs involve inherent risks, including but not limited to accidents, injuries, illness, or loss of personal belongings. Participants voluntarily assume all such risks associated with their participation.

5.2. Release of Liability: Participants agree to release, discharge, and hold harmless the Company, its directors, employees, agents, and representatives from any and all claims, actions, or liabilities arising out of or in connection with their participation in the program.


6.1. Modification: The Company reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be effective upon posting the updated version on the Company’s website. It is your responsibility to review the Terms and Conditions periodically to stay informed of any updates.

6.2. Severability: If any provision of this Agreement is deemed invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

6.3. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Nepal.

6.4. Entire Agreement: This Agreement constitutes the entire agreement between you and the Company, superseding any prior agreements or understandings, whether oral or written, relating to the subject matter herein.

6.5. Waiver: The failure of the Company to enforce any provision of this Agreement shall not be deemed as a waiver of that provision or any other provision.

6.6. Assignment: You may not assign, transfer, or sub-license any of your rights or obligations under this Agreement without the prior written consent of the Company. The Company may freely assign, transfer, or delegate any of its rights or obligations under this Agreement.

By participating in a trekking or adventure program organized by Himalayan Challenge Treks Pvt Ltd, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions. It is recommended that you retain a copy of this Agreement for your records.
